DUI & Alcohol-Related Accidents
When an irresponsible person chooses to drink and drive, that decision can have a devastating effect on the lives of others. At the law offices of Ginsberg & O'Connor, P.C., we represent the victims. From our office in Mount Laurel, our lawyers represent people throughout Central and South Jersey who have been injured in drunk driving accidents.
Holding Drunk Drivers Accountable
Drunk drivers can face both criminal and civil consequences for causing an accident that injures another person. The criminal case is about punishing the drunk driver. The civil case is about compensating the victim for damages such as medical bills, pain and suffering, lost wages and disability. Courts may also award punitive damages. Punitive damages are damages beyond your actual losses and are designed to punish the drunk driver.
Our lawyers will work side by side with the state’s criminal prosecution to build the strongest possible civil case against the drunk driver. If the drunk driver is uninsured or does not have enough insurance to pay for your damages, we can seek compensation from other sources such as your own uninsured motorist and underinsured motorist (UM/UIM) coverage. If the drunk driver was overserved alcoholic beverages by a bar or restaurant, the establishment may be responsible under New Jersey’s dram shop liability laws.
The drunk driver may also be held personally responsible for the damages that he or she causes, and those damages cannot be discharged by filing bankruptcy.
