The Statute of Limitations on Injury Claims in New Jersey
In New Jersey, there is a statute of limitations for personal injury claims. The law establishes a two-year limit. This starts on the day the injury occurs, or on the day the person discovers it, if at a later date. They then have two years to start a case seeking financial compensation from the responsible party.
It is often best not to wait for the statute of limitations to run, but to act quickly and file a claim immediately. However, there are situations in which this is not possible.
For instance, someone may not have believed that they suffered severe injuries. Still, it came to light during later medical appointments that their injuries were actually much more substantial than they thought. If it has only been a few months, people sometimes assume that it is already too late to start a personal injury claim. However, under New Jersey law, they do have a full two years.
It is also important to consider the long-term impact of injuries, which may not be apparent immediately. For instance, if someone suffers a spinal cord injury, they may hope to make a full recovery with physical rehabilitation and medical care. But after a year, they may realize that they are going to have a lifelong disability and that they may never recover some of the mobility they had before the accident. This significantly changes their situation, and they may need to seek substantial compensation for these long-term costs. They can still do so if they are within the two-year window.
Accident victims should visit their doctor, consult their insurance policy, file a claim if necessary, and gather as much documentation and evidence as they can. This can include medical records showing the severity of injuries or the projected impact on their lives, along with police reports and witness statements to demonstrate who was at fault in the accident. It is best for people to do this right after the event so they have the necessary evidence to support a claim, even if they do not start their case until later.
Why Hire a Personal Injury Attorney?
- To protect your rights — Insurance companies may delay payment, downplay compensation, or deny your claim entirely. An attorney represents you and only you. Our job is to assert your legal rights and guide you through the legal process.
- To ease your burdens — Dealing with claims adjusters yourself is stressful and risky. Our attorneys can deal directly with insurance companies on your behalf and help you address medical bills and related legal matters while your case is pending.
- To hold them accountable — The other party and their insurance company may deny fault — or even blame you! A personal injury lawyer can establish the other party’s negligence and their legal duty to you. Our lawyers can also identify the liability of any third parties that may apply.
- Research shows that claimants without legal representation typically receive lower compensation. Our attorneys know how to calculate and justify damages, including future medical expenses, loss of earning capacity, and pain and suffering, to obtain the full value of your case.
- Professional negotiators — Personal injury lawyers work on a contingency fee. They don’t get paid unless they recover compensation for you. We have the incentive to maximize the value of your case, and we know what legal strategies and documentation will yield the best result.
Why It’s Important to Hire an Experienced Trial Lawyer
Most personal injury cases settle out of court. So why do you need a trial lawyer? The obvious answer is that your case could be the one that goes to a jury. If the insurance company plays hardball, you need to know that your attorney will not cave in. Attorneys who rarely try cases may take a low settlement to avoid the courtroom. We try about 20 cases every year.
Even if your case never gets to a jury, it may involve discovery motions, hearings, and pretrial conferences in front of a judge. Having a trial attorney who understands court procedure and is prepared to go the distance protects your interests and gives you better leverage for a favorable out-of-court settlement.
